Procedure

1. Basic priciples
__
The WELL label for sanitary valves is awarded the VDMA  GmbH.

The classification is voluntary and open to all manufacturers of relevant products.

The classification is carried out on the basis of the Water Efficiency Labelling Classification Scheme (WELL) in its latest applicable version. (see download area)

Classifications based on earlier versions remain valid until their expiration date.

Provided that EN standards exist for the products covered by the classification system, fulfillment of these standards is a basic precondition for being awarded a WELL label. A test report from a laboratory accredited according to EN ISO/IEC 170255 is acceptable as proof.

As evidence of conformity with the WELL rating criteria, an assessment of by one of the partner testing institutes is required – unless otherwise stated.


2. Procedure and fees

The WELL classification procedure is carried out exclusively on-line.

The application shall be accompanied by following documents:
  • For wash basin, bidet and shower taps
    • Declaration of EN-standards conformity of the manufacturer in accordance with ISO/IEC 17050-1
    • WELL-attestation certifying the corresponding label classification, including information on.
      • Energy consumption (A to F)
      • Flow rate
      • Comfort-rating (max. 6 Stars for Public and 4 Stars for Home)
      • Comfort-features
        • Temperature regulation
        • Time control (Public)
        • Noise class
  • For urinal and toilet flush systems
    • Declaration of EN-standards conformity of the manufacturer in accordance with ISO/IEC 17050-1
    • WELL-attestation certifying the corresponding label classification, including information on.
      • Flush volume
      • Flush programme
      • Comfort-rating
  • For accessories
    • Declaration of EN-standards conformity of the manufacturer in accordance with ISO/IEC 17050-1
    • WELL-attestation certifying the corresponding label classification, including information on.
      • Energy consumption (A to F)
      • Flow rate
      • Comfort-rating
After application the applicant receives an automatic acknowledgement with a payment request for the processing fee.

The registration fee is 250 Euros for VDMA members and 500 euros for non-VDMA, plus the statutory rate of VAT. A registration fee is due for each label.

VDMA Services will check the application after receipt of payment. The data in the application must correspond with the WELL attestation issued by one of WELL partner institutes.

After approval of application, the applicant receives the requested label in form of a printable pdf document of the requested label.

The registration is entered in the online label register.

The classification is valid for 5 years. This entry in the label register will be automatically deleted, if no further extension is proceeded. An extension for another 5 years is possible.

If the application contains errors or is incomplete it will be rejected without repayment of the registration fee. In case of rejection the applicant shall be informed about the specific reasons.


3. Use
__
VDMA Services has all rights to the label and the Water Efficiency Labelling Classification Scheme.

The WELL label may only be used by the applicant and only in its original format, enlarged or reduced if required and in black and white style. For this purpose different label version will be provided for download in the applicants account after the WELL-label has been released by VDMA Services.

The WELL label may only be used in connection with the related classified product or product family. Same applies for advertising with the WELL label (for example in product catalogues).

The applicant themselves are responsible for form, content and legal admissibility of advertisements connected with the label. Any liability ofVDMA Services is excluded.

The holder of a WELL label is not permitted to pass on the label to a third party.


4. Market surveillance
__
Every year, VDMA Services asks the label owners for evidence of compliance with EN standards - in the form of a test carried out by one of our partnering testing institutes - on two percent of its classified products.

Samples are selected by a notary public, according to the principle of randomisation.

Evidence of compliance with EN standards may be provided by means of
  • Qualified test protocols/reports;
  • Appropriate tests carried out by partnering testing institutes.
Should no appropriate evidence of compliance with EN standards exist, such evidence is to be provided within 6 months by means of appropriate tests.

If such evidence is not procured, the WELL label for the product or the product family in question will be revoked.

Should the label owner find himself unable to perform his obligation to provide such evidence within the given time period, due to limited or over-utilised testing capacities of the partner testing institutes, he may request a deadline extension no later than 14 days prior to the deadline by submitting a written confirmation issued by the testing institute charged with carrying out the test (hartmut.tembrink@vdma.org).

The respective WELL label owner bears the costs incurred in connection with the sample testing process.


5. Infringement measures

VDMA Services reserves the right to begin proceedings against misuse of the WELL label.

In the event of infringements against the usage conditions, in particular
  • misuse of the label,
  • incorrect identification of products (i.e. identification of products, which do not correspond to the classified technical documentation),
  • misconduct, which threatens the standing of VDMA Services and the reputation of the accredited testing institute in,

VDMA Services may take following measures:
  • impose a warning with a time limit,
  • inflict payment of a contractual penalty depending on the extent of culpability as a fine in favour of VDMA Services of up to 25,000 Euros,
  • permanently or temporarily withdraw the label and the related right to classify the products.


6. Court of jurisdiction

The court which has jurisdiction is Frankfurt/Main, Germany.
